Terms of Service

1. Acceptance of Terms

By using Oshy, you agree to these terms. If you do not agree, do not use the service.

2. Description of Service

Oshy is a hydration tracking application that helps you monitor and improve your daily water intake through personalized targets and companion-based engagement.

3. User Accounts and Eligibility

You must be at least 13 years old to use Oshy. You are responsible for maintaining the accuracy of the information you provide in the app, including any health-related inputs used to calculate your daily hydration target.

4. Acceptable Use

You agree to use Oshy only for its intended purpose. You will not attempt to reverse-engineer, misuse, or interfere with the service.

5. Intellectual Property

All content, design, characters (including Oshy and future Siplets), and branding are the property of Kularion FZCO. You may not reproduce, distribute, or create derivative works without permission.

6. Subscriptions and In-App Purchases

Oshy is offered on a premium-only basis. Access to the app's features requires an active subscription or a one-time Lifetime purchase, both sold through the Apple App Store.

Free trial

New users are eligible for a 7-day free trial of the Yearly or Monthly subscription. The trial is offered by Apple under its standard introductory-offer terms: one free trial per Apple ID per subscription group. If you have previously used the Oshy Premium trial on another device signed into the same Apple ID, you will not be eligible for another trial.

Billing and auto-renewal

When you start a subscription, payment is charged to your Apple ID at confirmation of purchase (or, for a free trial, at the end of the 7-day trial period). Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours prior to the end of the current period at the price of your chosen plan. The price shown in the app at the time of purchase is the price you pay, in your App Store region's local currency.

Cancelling a subscription

You can cancel at any time by going to Settings → [Your Apple ID] → Subscriptions on your iPhone, selecting "Oshy Premium," and turning off auto-renewal. Cancelling stops future renewals. The current billing period remains active until its natural end.

Discount and Lifetime options

Oshy also offers a discounted yearly subscription (no free trial; billed immediately) and a Lifetime one-time purchase (non-consumable; no renewal) as alternatives to the standard trial-based plans. These are shown on a secondary paywall when you dismiss the primary paywall. The Lifetime purchase grants permanent access to Oshy Premium on any device signed into your Apple ID and is not subject to renewal or recurring billing.

Restoring purchases

If you have previously purchased Oshy Premium on another device, or reinstall the app, tap "Restore" on any paywall to restore your entitlement. Restore uses your Apple ID and does not require an email or password from us.

Refunds

All subscription and one-time purchases are processed by Apple. Refund requests must be submitted to Apple through their standard process at reportaproblem.apple.com. Kularion FZCO cannot directly issue refunds for purchases made through the App Store.

Apple's standard EULA

In addition to these Terms, your use of Oshy is also governed by Apple's standard End User License Agreement for apps distributed through the App Store, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where any conflict exists between these Terms and Apple's EULA in respect of App Store mechanics (payment, refunds, licence grant), Apple's EULA governs.

7. Price Changes

We may change the price of future subscription terms. If the price of your auto-renewing subscription changes, Apple will notify you in advance and require your explicit consent before charging the new price. You may cancel your subscription in response to any price change. Changes to one-time purchase prices (including Lifetime) do not affect purchases already completed.

8. Health Disclaimer

Oshy provides general hydration guidance based on publicly available health guidelines. It is not medical advice and is not a substitute for professional health consultation. Always consult a healthcare provider for medical decisions. Your daily target is a personalized estimate, not a clinical prescription.

Oshy's daily hydration target is calculated from generally accepted hydration guidelines (EFSA, NHS, and WHO) using the inputs you provide. It is not a clinical prescription, does not account for individual medical conditions, and should not be used to manage any specific health condition. If you are pregnant, breastfeeding, managing kidney or cardiovascular conditions, or otherwise have unusual hydration needs, consult a healthcare provider.

9. Limitation of Liability

Oshy is provided "as is" without warranties of any kind. Kularion FZCO is not liable for any damages arising from your use of the service, including but not limited to health outcomes based on hydration targets.

10. Termination

We may suspend or terminate your access to Oshy at our discretion. You may stop using the service at any time.

11. Governing Law

These terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Sharjah, UAE.

12. Changes to Terms

We may update these terms from time to time. Continued use of Oshy after changes constitutes acceptance of the updated terms.
